Posle neslavne sudbine SOPA i PIPA zakonskih predloga u SAD i na evropskom tlu se otvorilo pitanje strožije zaštite autorskih prava na internetu. AKTA (Anti-Counterfeiting Trade Agreement) je međunarodni sporazum koji iako u ideji ima razuman cilj: zaštitu autorskih prava pre svega na polju lekova, dela muzičke i filmske industrije, način sprovođenja te zaštite je za internet zajednicu u najmanju ruku smatran nerazumnim. Posebno kontroverzno je i to što su pregovori oko potpisivanja AKTA trajali dosta dugo u tajnosti, da bi na kraju bili potpisani od strane značajnih zemalja među kojima SAD-a, Japana, Australije, EU i 22 države članice EU. Širom Evrope su se pojavili protesti protiv potpisivanja AKTA sporazuma, koji su u nekim zemljama i postigli cilj, tako da je ratifikacija AKTA sporazuma povučena iz procedure. Na nivou EU, Evropska komisija je poslata AKTA sporazum Evropskom sudu pravde na ocenu da li je u skladu sa evropskim vrednostima.
A šta se dešava u Srbiji?
Treba podsetiti da је u decembru 2011. godine donet zakon o izmenama i dopunama Zakona o autorskim i srodnim pravima kojim je u mnogim segmentima usklađeno naše zakonodavstvo sa zakonodavstvom EU i međunarodnim konvencijama na polju zaštite autorskih prava. Ovo posebno dobija na značaju imajući u vidu i činjenicu da je prethodno doneta Strategija razvoja intelektualne svojine u Republici Srbiji za period od 2011. do 2015. godine, takođe menjana krajem 2011 godine i po mnogima upravo na način tako da je usaglašena sa AKTA sporazumom. Ubrzo su počele da se pojavljuju po domaćim medijima informacije da Srbija planira da pristupi AKTA sporazumu, što je ispraćeno burnom reakcijom internet zajednice u Srbiji i organizovanjem protesta po većim gradovima Srbije. Takođe su se oglasili i pravni stručnjaci i Poverenik za informacije od javnog značaja sa svojim stavovima prema sporazumu, kao i političke stranke koje su, upitane na društvenim mrežama da li će podržati AKTA sporazum, mahom bile protiv potpisivanja navedenog sporazuma. Ubrzo se oglasilo i Ministarstvo prosvete i nauke sa saopštenjem za javnost da su informacije o pristupanju Srbije AKTA sporazumu netačne, ali da će Srbija pri regulisanju pojedinih oblasti života i rada kao i do sad harmonizovati sa zakonodavstvom EU i primerima najbolje svetske prakse.
Internet društvo je u svom saopštenju pozvalo sve relevantne faktore da ponovno razmisle o ratifikaciji AKTA i da sarađuju na otvoren način sa svim zainteresovanim licima širomsveta da bi se izgradila rešenja za zaštitu autorskog prava na internetu koje je ujedno lokalno relevantno i globalno održivo.
