Regulacija Evropske Unije sadrži principe koji korisniku garantuju povezivanje na bilo koji deo mreže bez diskriminacije. Međutim, pojedini delovi regulacije mogu biti iskorišćeni kako bi se umanjila neutralnost mreže. Zakonodavci su odlučili da odgovornost za tumačenje pravnih nedoumica u tekstu prepuste internet operaterima.

 

Telo evropskih regulatora za elektronske komunikacije (The Body of The European Regulators of Electronic Communications – BEREC) ima zadatak da pripremi smernice za tumačenje dvosmislenosti u zakonu do kraja avgusta 2016. godine. Ove smernice će uticati na to da li će Evropa ostvariti neutralnost mreže ili ne.

 

Tokom juna meseca BEREC planira da objavi predlog ovih smernica i da pokrene javne konsultacije. Ipak, vremenski rokovi koji su predviđeni za celokupan proces konsultacija su veoma kratki – javnost ima rok od samo 20 radnih dana da dostavi predloge izmena zvaničnog teksta.
